Stan Heffner involved in major ethics violantions

The head of ODE and State Superintendent Stan Heffner, has been found in violation of state ethic laws according to an Inspector General report issued today. This investigation was prompted by Plunderbund reporting.

CONCLUSION TO THE INITIAL ALLEGATION At the time of his testimony before the Ohio Senate Finance Committee, Heffner had already interviewed and secured a position at Educational Testing Service (ETS). Heffner negotiated the conditions of his employment with ETS, signed an offer, and began the process of transitioning from Ohio to San Antonio, Texas. He had met with ETS officials out of state and allowed them to pay for his travel; he took time from attending an out-of-state conference on behalf of ODE to meet with ETS officials. Heffner’s testimony supported legislation which would result in an increase of testing for Ohio’s school teachers. Based on the prior relationship between ODE and ETS, it was inappropriate for Heffner to give testimony in support of this bill given the strong likelihood that ETS could stand to profit.

Ohio Revised Code Section 121.41 defines at division (G): “Wrongful act or omission” means an act or omission, committed in the course of office holding or employment, that is not in accordance with the requirements of law or such standards of proper governmental conduct as are commonly accepted in the community and thereby subverts, or tends to subvert, the process of government.

By providing testimony to the legislature as the state’s principal employee for leadership in education, in support of a bill that could and ultimately did benefit a corporation with which he had entered into an agreement of employment, Heffner failed to meet the standards of proper governmental conduct as are commonly accepted in the community and subverts the process of government.

Accordingly, the Office of the Ohio Inspector General finds reasonable cause to believe wrongful acts or omissions occurred in these instances.

The report further details other violations uncovered during their investigation, including the misuse of state time and resources.

ADDITIONAL ISSUES DISCOVERED DURING THE INVESTIGATION
While investigating the initial allegations, the Office of the Ohio Inspector General found during the course of negotiating the employment agreement between Heffner and ETS, Heffner advised associates at ETS to use both his state-issued cell phone and his state email account as the preferred method of contact to conduct non-state business arrangements.

Further evidence has Heffner directing state employees to make personal arrangement for him, as he was looking for a new job. Here's just one of many examples uncovered

In addition, Heffner’s former executive secretary also provided documentation of email instructions addressed to her by Heffner for preparing an envelope to send an employment application to USD. (Exhibit 13) She also stated that Heffner instructed her to coordinate a flight to Washington, D.C., for a meeting between Heffner and ETS. She stated that though ETS scheduled the flight, she was instructed to convey the details of the flight to ETS’s executive search company, JRS.

He directed his assistant to prepare and coordinate his move to Texas and the subsequent mortgage arrangements

Heffner’s executive assistant recalled on one particular day, Heffner brought in a brief case full of personal documents which were related to the potential purchase of a home in San Antonio, and for the sale of his home in Westerville. The new executive assistant explained Heffner instructed her to organize the documents and assist in getting the process “finalized” for the mortgage company. She described the documents as Heffner’s personal records such as tax returns, bank statements, letters of financial debt, and anything you would need for a mortgage company. She stated that from the personal documents given to her by Heffner, as mortgage companies would contact her, she would provide whatever documentation they were seeking and would utilize whatever state equipment was necessary to send or transmit them. Occasionally, she stated, Heffner would inquire as to how the process of his home purchase was proceeding and would want to know about “timelines.”

When asked if she believed that she had an option to refuse to perform this work she replied, “. . . and keep my job? Probably not.” She stated she was in “disbelief” that Heffner was instructing her to perform these personal tasks. She said, “My only option was to do what he needed and try to do it well so he, you know, so he would, so he would keep me.”

The Office of the Ohio Inspector General asks the State Board of Education of Ohio to consider whether administrative action is warranted and respond within 60 days detailing its decision.

According to a Dispatch Report, the Superintendent is appologizing but refusing to resign

Ohio schools Superintendent Stan Heffner quickly apologized for ethics allegations outlined in a state watchdog investigation released today but stopped short of stepping down from the post he has held for a year.

“I accept the findings of the Inspector General’s report. I was wrong and I’m sorry for my lack of judgment,” Heffner said in a statement released by the Ohio Department of Education.

“I’ve apologized to my staff, my friends and colleagues at the department, and the board. I have learned from my mistakes, and I will work with the board to take whatever steps they feel are necessary to resolve this matter and move forward.”

Science Fact

Corporate education reform science fiction, is having an unintended(?) science fact effect.

First the science

If VAM scores are at all accurate, there ought to be a significant correlation between a teacher's score one year compared to the next. In other words, good teachers should have somewhat consistently higher scores, and poor teachers ought to remain poor. He created a scatter plot that put the ratings from 2009 on one axis, and the ratings from 2010 on the other axis. What should we expect here? If there is a correlation, we should see some sort of upward sloping line.

There is one huge takeway from all this. VAM ratings are not an accurate reflection of a teacher's performance, even on the narrow indicators on which they focus. If an indicator is unreliable, it is a farce to call it "objective."

This travesty has the effect of discrediting the whole idea of using test score data to drive reform. What does it say about "reformers" when they are willing to base a large part of teacher and principal evaluations on such an indicator?

That travesty is now manifesting itself in real personal terms.

In 2009, 96 percent of their fifth graders were proficient in English, 89 percent in math. When the New York City Education Department released its numerical ratings recently, it seemed a sure bet that the P.S. 146 teachers would be at the very top.

Actually, they were near the very bottom.

Though 89 percent of P.S. 146 fifth graders were rated proficient in math in 2009, the year before, as fourth graders, 97 percent were rated as proficient. This resulted in the worst thing that can happen to a teacher in America today: negative value was added.

The difference between 89 percent and 97 percent proficiency at P.S. 146 is the result of three children scoring a 2 out of 4 instead of a 3 out of 4.

While Ms. Allanbrook does not believe in lots of test prep, her fourth-grade teachers do more of it than the rest of the school.

In New York City, fourth-grade test results can determine where a child will go to middle school. Fifth-grade scores have never mattered much, so teachers have been free to focus on project-based learning. While that may be good for a child’s intellectual development, it is hard on a teacher’s value-added score.

These teachers are not the only ones.

Bill Turque tells the story of teacher Sarah Wysocki, who was let go by D.C. public schools because her students got low standardized test scores, even though she received stellar personal evaluations as a teacher.

She was evaluated under the the D.C. teacher evaluation system, called IMPACT, a so-called “value-added” method of assessing teachers that uses complicated mathematical formulas that purport to tell how much “value” a teacher adds to how much a student learns.

As more data is demanded, more analysis can be done to demonstrate how unreliable it is for these purposes, and consequently we are guaranteed to read more stories of good teachers becoming victims of bad measurements. It's unfortunate we're going to have to go through all this to arrive at this understanding.

Gates: "Poverty is an excuse"

Billionaire corporate education reformer Bill Gates has become increasingly bizarre in his public proclamations. We reported a short while ago about his slip that sounded an awful lot like an admission he would like to privatize public education.Now he seems to think poverty is no obstacle, all we have to do is hand poor students over to a charter school

Microsoft founder Bill Gates told the National Urban League on Thursday that a child's success should not depend on the race or income of parents and that poverty cannot be an excuse for a poor education.

Gates, who now runs the Bill and Melinda Gates Foundation, cited his foundation's work with charter schools as an example.

At least he has enough self awareness to know he doesn't know what he is talking about

"Let me acknowledge that I don't understand in a personal way the challenges that poverty creates for families, and schools and teachers," the billionaire said at the civil rights group's annual convention.

You can further forgive Gates, because it's not like there is very much research showing the direct ties between poverty and educational achievement.

All just excuses, right?

Repealing SB5 isn't partisan, it's personal

Yesterday, over 600 labor leaders packed the pipefitters union hall on Kinnear Road in Columbus to discuss the next phase of the repeal effort. What is becoming clearer and clearer with each passing moment is the shear scale of the opposition to SB5. It was a mid July day with temperatures soaring over 100 degrees, yet people had come together in their hundreds for a closed to the press event, whose nature might usually attract only 30.

It's not just the numbers that should cause supporters of SB5 to take stock, but the breadth of opposition. The gathering represented over 2 million members, from public and private sector unions. While much focus has been placed on the direct assault on teachers, police and fire, private sector allies have stepped up and into the fray too, to lend their considerable support.

Everyone recognizing SB5 for what it is, a direct and indirect assault on working men and women in Ohio.

As if to punctuate this huge gathering, it happened, by coincidence, on the same the day that Secretary of State John Husted certified that voters would guaranteed the opportunity to repeal SB5 in November on the back of a record breaking signature collection effort

Secretary of State Jon Husted certified a state-record 915,456 valid signatures collected by a coalition seeking to repeal the Republican-backed law that weakens collective bargaining for public employees. Only 231,147 were needed to place a referendum on the ballot.

On June 29, We Are Ohio, the coalition opposed to Senate Bill 5, delivered nearly 1.3 million signatures to Husted's office for validation -- smashing the previous state record. Those signatures were shipped to their respective county boards of election for initial validation, and Husted was responsible for final certification.

In addition to cruising past the threshold for total number of valid signatures, We Are Ohio also collected signatures equal to 3 percent of the total vote cast in last year's gubernatorial election in all 88 counties -- which campaign spokesman Melissa Fazekas said was also a first in Ohio history.

The effort isn't massive because it's partisan, we see that all the time, it's massive because for millions of workers from across the political spectrum, it is personal.

The Reckless Budget

The Budget Facts, so far

  • The budget leaves school districts with $3.1 billion less overall funding over the next two years. That means school districts will have 11.5% less total funding next year, and a 4.5% further decrease in the budget’s second year, forcing drastic cuts and property tax increases.
  • There are no strategies to make up for an estimated $800 million in annual lost federal funding.
  • The budget reneges on “hold harmless” payments to schools during the phase-out period for Tangible Personal Property Taxes, costing school districts $678 million over two years.
  • The budget provides nearly $400 million less over the biennium to higher education, including a 5% cut to the Ohio College Opportunity Grant next year.
  • The cuts extend to nearly every area of education – early childhood, special education, prison education and instruction for incarcerated youths.
