Senate budget - good, bad, ugly

The much anticipated Senate budget, when it comes to education policy, could be titled "The Good, the Bad and the Ugly". We've already discussed the ugly, let's take a look at the good and the bad.

The Good

The statewide parent trigger, proposed by the governor and eliminated by the house, is not proposed by the Senate either and appears dead, for now.

The Senate also includes a fix to HB555 and the onerous teacher evaluation provisions it contained. Here's what the fix proposes

Prescribes that the student academic growth factor must account for 35% (rather than 50% as under current law) of each evaluation under the standards-based state framework for evaluation of teachers developed by the State Board of Education and permits a school district to attribute an additional percentage to the student academic growth factor, not to exceed 15% of each evaluation.

Specifies that, when calculating student academic growth for a teacher evaluation, students who have had 30 or more excused or unexcused absences for the school year must be excluded (rather than excluding students with 60 or more unexcused absences as under current law).

Ohio Revised Code labels a student as a chronic truant if they are absent 14 days, so 30 days is still a high number of absences to allow, but it is certainly better than the ridiculous 60 days in current law. The reduction in the use of VAM to 35% from 50% is a welcome improvement.

The Governor proposed eliminating the single salary schedule, and the House concurred. The Senate however strikes this proposal from their budget. We suspect there will be pressure applied to put this back in. Educators and support professional should continue to apply their own pressure on legislators to keep it out.

The Senate also eliminated the home-school freeloading provision the House added that would have allowed home schoolers to participate in district extra-curricular activities at no expense.

The Bad

The Governor proposed a massive statewide voucher expansion effort, the House concurred, and the Senate has left the proposal in too. With massive opposition to this proposal we were a little surprised the Senate left this unnecessary proposal in their budget.

Charter schools get a number of additional free passes from the Senate, including an e-school exemption for phys ed., an additional qualifying condition for vouchers, and a provision that would make charter school closures more difficult as LSC notes it "May be more difficult to close community schools after July 1, 2013 (compared with current law after that date).". The Senate also eliminates a charter school teacher quality provision for charters populated primarily with students with disabilities. A number of other smaller provisions setting charter schools on a longer path to failure are also propsed by the Senate, such as:

Exempts students of chartered nonpublic schools accredited through the Independent School Association of the Central States from passing the end-of-course examinations as a prerequisite for graduation from high school.

The Charter school business doesn't contribute millions of dollars a year to Republican politicians for nothing.

The challenging

The Senate adds a new levy type aimed at school safety

Authorizes school districts to levy a property tax exclusively for school safety and security purposes. Requires the levy to comply with the same requirements that apply to general school district levies in excess of the 10-mill limitation.

A good intentioned proposal aimed at lowering violence in schools, but there should be concern that a safety levy might reduce local taxpayers appetites for funding levies for normal school operations, the core purpose of schools themselves. School districts will have to be mindful in how they approach this issue.

Public schools neglected in favor of private choice expansion

"The public common school," Horace Mann said, "is the Greatest Discovery made by man." It constitutes a social compact established for the benefit of all the children of all the people, community by community, across Ohio and across America. It has been the primary force for the common good in America.

Although a state system in Ohio, required to be thorough and efficient by constitutional decree, it is operated at the community level by elected boards of education-the fourth branch of government. In spite of inadequate levels of state funding through the decades, the public common school in Ohio and throughout the nation has nurtured this country to which millions and millions in every generation have migrated.

The public common school, typically, on a modest and constrained budget, has attempted to meet the individual needs of students. Programs for vocational/technical training, programs for those with disabilities and special needs, have been a part of the common school fabric. Typically, education options have been limited by the fiscal resources available to school districts.

In the past two decades, the political will to maintain and strengthen the public common school, and thus the social compact, the common good, has dwindled in a frenzied untested "quick fix" strategy that is fueled by many who want to take public money to the altar of the god of school choice.

The public common school system, due to the transfer of resources from the system to private choices, is less able to provide for choice; hence, students within the public common school system are being denied choices due to choice expansion outside the system.

The school funding measures in HB 59 (school funding level and non-formula school funding formula) are detrimental to most school districts while favoring the school choice movement. The state has the constitutional responsibility to maintain and nurture the common school system, not give it away.

The 130th General Assembly should put a moratorium on the expansion of school choice and establish a bipartisan, bicameral legislative research committee to study the current choice program.

Exposing ALEC’s agenda

The American Legislative Exchange Council (ALEC) has been hard at work for decades. Its members are organized, well-funded and connected–too bad they aren’t using their powers to do what’s right for students and schools.

Instead, they use all their resources to push an agenda to open up the public school system to vouchers and privatization, lobbying legislators to restrict everything from voting rights to workers’ rights to help pave the path to their success.

Stongsville Strike Primer

What's going on in Strongsville? Here's a good primer, via Diane Ravitch's blog.

My name is Christina Potter and I have taught in the Strongsville City Schools in Strongsville, Ohio for the last eight years.

When I was hired in Strongsville, a great community with excellent schools, many other teachers said I was lucky, and they were jealous of my new job, and during the first two years, they were right; things were great with all sides working together,and we earned Ohio’s highest ranking, Excellent with Distinction.

As time went on a division started to occur between the administration and the teachers. During our 2010 contract negotiations the school stated that times were difficult and they needed the teachers to make concessions. In good faith, and promise of a levy, we agreed to an additional two year pay freeze on top of the three years we had already taken. We also increased our medical expenses, took on an additional duty period, and agreed to work two days unpaid. Times were tough, but everyone was striving to make Strongsville great.

Then, everything went haywire. With the ink still drying on our contract, the Board tried to take the levy off the ballot but failed, so instead, they informed the community to vote the levy down. Then we learned that while the district cried broke in 2010, it spent $500,000 to hire an attorney who publicizes himself as a union breaker. Every school district in this area that has hired him has either gone on strike or threatened to. Needless to say, the teachers, who negotiated in good faith, were outraged.

When our contract ended in June 2012, the district asked for extra time before negotiating to get its finances in order, so on July 19th, the first negotiation session took place. Upon walking in, their attorney put a contract down on the table and told us it was a take it or leave it offer and refused to negotiate one item at a time. After months of failing to negotiate a contract, our Education Association declared an impasse, and a Federal Mediator came in to oversee negotiations. Here is the timeline of recent events:

1. On February 15th, 2013 the teachers of the Strongsville Education Association (SEA) overwhelmingly passed a strike authorization.

2. On February 22nd, SEA submitted a 10-day notice of our intent to strike.

3. On March 1st, I had to hand in my I.D. badge and keys and have all of my personal belongings out of the building by 3:15 p.m. After 3:15, the doors would be locked, and anyone still on school property would be arrested even though we had not taken a final strike vote; we also had another negotiation session scheduled for Saturday morning. For all intense purposes we were not on strike yet but we were being locked out of the buildings, our email accounts and our grade books.

4. On March 2nd, both negotiating teams and the School Board members met with the federal negotiator. At that time the school gave its final offer which was only slightly different than their original.

And that takes us to where we are today, on strike. Many of my fellow teachers are also Strongsville residents, who have children in the system. They fear we are destroying our great public schools by trashing the teaching profession within them, instead of working toward a settlement. They feel the Board has chosen to waste tax payer money and painted teachers as greedy; meanwhile, it has forked over another $500,000, for a total of $1 million, to an attorney instead of using the money for books and technology.

Why are we striking in the cold, wind, and snow from 5:30 a.m. to 4 p.m. We, the Strongsville teachers, feel we are not just standing for the SEA, but for all of our fellow public school teachers in the Ohio and across the nation during this statewide/national epidemic of privatizing our public schools. If this contract goes through other school districts may soon go after their teachers, and we cannot in good conscience allow that to happen. As a teacher and a parent of two, I believe in public education and its hard working teachers, who too often are the brunt of undeserved bashing.

The teachers of Strongsville will hold a rally this afternoon at 4 pm in the center of Strongsville, at the gazebo, at the corners of Pearl Rd. and Rt 82.

It makes it harder to collectively bargain for life-saving equipment, staffing and other safety issues for the brave men and women that protect us, like police officers and firefighters It takes away the professional voices of those we trust to take care of our children and families, such as teachers and nurses It is wrong because it means less money, lower wages and fewer benefits for you, me and all of us in the middle class. Communities thrive and grow when Ohioans have good paying jobs. Let's stand up together and stick together for a decent standard of living.
