So-called "right to work" Hot Potato

The House Manufacturing and Workforce Development Committee, chaired by Rep. Schuring (R) held the first reading of HB151 and HJR5 - the anti worker so-called "right to work" legislation. They heard from the bills sponsors, Rep. Roegner (R) and Rep. Maag (R).

The hearing room was packed to capacity by opponents of the bill, indeed so many people were in opposition to this bill that they filled two additional overflow rooms, and left some standing in the hallways listening over a speaker system.

Educators opposing so-called 'right to work'

As expected, Rep. Roegner and Rep. Maag gave misleading and highly selective testimony, that failed to stand up to questions from the committee. Often they had to fall back upon "feelings", "beliefs" and ad nauseam recitation of the word "freedom" like they were auditioning for the role of William Wallace in an off-Broad St. production of Braveheart.

Rep. Tom Letson (D-Warren) said Ohio law already allows employees to choose not to belong to unions and instead contribute "fair share" payments. "It seems as though the freedom you are espousing here is already in the body of the law," he said, suggesting the proposal was redundant.

The Democrat's statement drew a roar of applause from the audience, prompting Chairman Schuring to slam the gavel and warn spectators to observe proper decorum or be ejected from the room.

Rep. Roland Winburn (D-Dayton) questioned whether the measure would allow workers who choose not to pay union dues to benefit from the union's representation and called it "a right-to-freeload law more than the workplace freedom law."

Rep. Patterson said he believed allowing individual workers to "cut their own deals" with management effectively undermines the efficacy of collective bargaining and asked the sponsors if they thought the measure would weaken labor unions in the state.

The hearing was more notable for what didn't happen, rather than what did. Not a single Republican questioned their colleagues about their proposed bill, despite intense questioning by the Democrats on the committee. It was also apparent that there were few, if any supporters of the bill at the hearing.

The lack of a convincing case for the bill, a lack of support in the Republican caucus, and widespread opposition led the chairman to declare the bill dead in his committee

The chairman of a House panel that heard testimony on controversial right-to-work legislation Tuesday said there would be no further hearings on the matter in his committee.

Chairman Rep. Kirk Schuring (R-Canton) said after the hearing that members of the panel had unanimously agreed not to continue deliberations on the proposals.

"I've surveyed the committee and for a wide variety of reasons, the committee has determined that it would not be appropriate to have additional hearings on the legislation," he said in an interview.

"My individual thoughts are that I've been in the legislature now for 20 years and I have not had one union shop - an owner of a company that is a union shop or an executive from a company that is a union shop - has come to me and asked for this type of legislation," the chairman said.

"So I think it's something that does not need to be addressed at this point in time. There are a whole host of other issues regarding our economy and how we can improve the economic climate in this state that we need to address."

The chairman's comments reflect the radioactive nature of the issue currently for majority Republicans who saw an attempt to curb union collective bargaining thrown out by voters last session (SB5, 129th General Assembly).

With that, the Republicans in the Ohio House passed this hot potato to their Tea Party grassroots activists. Signature collection by right wing extremists now being the only route left for this legislation to move forward. With that signature collection deadline fast approaching, and reports that the Tea Party are struggling to collect those signatures, it is unlikely a so-called "right to work" amendment will find its way onto a ballot this year. This Leaves next year (when the governor and most of his legislative pals are up for reelection) as the next possible date, followed shortly afterwards by the lame duck session of 2014.

But for now, it doesn't look like anyone wants to be left holding this anti-worker, deceitful hot potato.

Senate budget - good, bad, ugly

The much anticipated Senate budget, when it comes to education policy, could be titled "The Good, the Bad and the Ugly". We've already discussed the ugly, let's take a look at the good and the bad.

The Good

The statewide parent trigger, proposed by the governor and eliminated by the house, is not proposed by the Senate either and appears dead, for now.

The Senate also includes a fix to HB555 and the onerous teacher evaluation provisions it contained. Here's what the fix proposes

Prescribes that the student academic growth factor must account for 35% (rather than 50% as under current law) of each evaluation under the standards-based state framework for evaluation of teachers developed by the State Board of Education and permits a school district to attribute an additional percentage to the student academic growth factor, not to exceed 15% of each evaluation.

Specifies that, when calculating student academic growth for a teacher evaluation, students who have had 30 or more excused or unexcused absences for the school year must be excluded (rather than excluding students with 60 or more unexcused absences as under current law).

Ohio Revised Code labels a student as a chronic truant if they are absent 14 days, so 30 days is still a high number of absences to allow, but it is certainly better than the ridiculous 60 days in current law. The reduction in the use of VAM to 35% from 50% is a welcome improvement.

The Governor proposed eliminating the single salary schedule, and the House concurred. The Senate however strikes this proposal from their budget. We suspect there will be pressure applied to put this back in. Educators and support professional should continue to apply their own pressure on legislators to keep it out.

The Senate also eliminated the home-school freeloading provision the House added that would have allowed home schoolers to participate in district extra-curricular activities at no expense.

The Bad

The Governor proposed a massive statewide voucher expansion effort, the House concurred, and the Senate has left the proposal in too. With massive opposition to this proposal we were a little surprised the Senate left this unnecessary proposal in their budget.

Charter schools get a number of additional free passes from the Senate, including an e-school exemption for phys ed., an additional qualifying condition for vouchers, and a provision that would make charter school closures more difficult as LSC notes it "May be more difficult to close community schools after July 1, 2013 (compared with current law after that date).". The Senate also eliminates a charter school teacher quality provision for charters populated primarily with students with disabilities. A number of other smaller provisions setting charter schools on a longer path to failure are also propsed by the Senate, such as:

Exempts students of chartered nonpublic schools accredited through the Independent School Association of the Central States from passing the end-of-course examinations as a prerequisite for graduation from high school.

The Charter school business doesn't contribute millions of dollars a year to Republican politicians for nothing.

The challenging

The Senate adds a new levy type aimed at school safety

Authorizes school districts to levy a property tax exclusively for school safety and security purposes. Requires the levy to comply with the same requirements that apply to general school district levies in excess of the 10-mill limitation.

A good intentioned proposal aimed at lowering violence in schools, but there should be concern that a safety levy might reduce local taxpayers appetites for funding levies for normal school operations, the core purpose of schools themselves. School districts will have to be mindful in how they approach this issue.

Rejected Kasich formula coming back?

The Ohio Senate revealed its version of the Budget, and it contained a number of changes to education policy proposals proposed by the Governor and the House. What it didn't contain was a school funding formula, for that we are told we will have to wait another week. A familiar story.

Based upon reporting, there should be some serious cause for concern. The Toledo Blade reports

A huge chunk still missing from the budget is how the chamber plans to deal with K-12 schools, preventing lawmakers from putting a total price tag on the two-year spending plan for the moment. Talks continue, but Mr. Faber predicted that the final product is likely to be closer to what Mr. Kasich initially proposed than what the House put forth.

Mr. Kasich’s school funding plans, particularly his promise that more money would flow to poorer schools, were initially greeted with optimism by school superintendents across the state. But that mood quickly soured when the administration released numbers showing that some 60 percent of school districts would see no funding increases while some wealthier, fast-growing, suburban districts were in line for large increases.

The House, in turned, capped the growth in subsidies to those suburban schools, resulting in more districts being in line for increases, including Toledo Public Schools. Mr. Faber would not speculate what the Senate’s total K-12 pot of funding would be larger or smaller than in the House version.

The Cincinnati Enquirer has a reaction

Senate Minority Leader Eric Kearney, D-North Avondale, said the small business tax cut wouldn’t provide business owners with enough money to create new jobs. He also lamented the budget’s lack of additional funding for local governments and schools.

“Our schools and local communities have suffered drastic cuts since Governor Kasich took office and today’s amendments by Senate Republicans to (the budget bill) did nothing to change that,” he said in a statement. “That’s not good news for local taxpayers who’ve been forced to pick up the slack from state funding cuts by voting for more local levies.”

Senate Republicans said they won’t have education funding numbers until next week, when they plan to reveal their final K-12 funding plan.

The Governor promised that poor districts would receive more, which should not have been a difficult task after he cut education funding by $1.8 billion in his last budget. But even that promise turned out to be empty as almost 400 school districts were set to receive flat funding. The House promised to fix the Governor's mess, and attempted to do so by returning to the Taft era building blocks formula - only they cut school funding by a further $200 million in the process. Now the Ohio Senate wants to return to the Governor's rejected formula. As we predicted, we have a school funding disaster on our hands, unless the Senate is also going to attach significant amounts of additional money to the plan to make it workable.

Will Ohio's media be bamboozled a third time by Republican legislators?

SB21 Decoded

A number of readers have asked us to decode the Ohio House's version of SB21, which is likely to be passed into law.

In the area of teacher qualifications, after July 1, 2013, third grade students who have been retained or are on a reading improvement plan shall be assigned to a teacher who has at least one year of teaching experience and satisfies one of the following criteria:

a) K-12 reading endorsement on their teaching license
b) Master’s degree in reading or literacy
c) Rated “most effective” for reading instruction for the most recent two years based on student growth measures
d) Rated “above expected value added” in reading instruction as determined by criteria established by ODE for the most recent consecutive school years
e) Passed a rigorous test of principles of scientifically research-based reading instruction approved by the State Board of Education
f) Holds a teaching license for P-3 or 4-9 issued on or after July 1, 2017

The House version limited or did away with qualifications in the Senate version that allowed for evidence of completion of a program of scientifically research-based reading instruction programs approved by the department (limited to until July 1, 2016) or the teacher is an effective reading instructor as determined by criteria established by the department (eliminated).

The House version of the bill also expands who may offer services in the following ways:

  • A teacher with less than one year of experience provided they meet one of the qualifications and is assigned a teacher mentor who meets one of the qualifications
  • Through July 1, 2016, a teacher who has successfully completed training on reading instruction approved by the department
  • A teacher other than the classroom teacher to whom the student is assigned provided the teacher meets the qualifications, the teacher and the principal agree and the assignment is documented in the student’s reading improvement plan
  • A speech language pathologist may provide reading intervention and remediation services

Additionally, the House version of the bill allows school districts who cannot furnish the number of teachers to satisfy the qualifications to submit a staffing plan to the Ohio Department of Education. ODE may grant extensions of district staffing plans through the 2015-2016 school year.

Other provisions of the House passed version of SB 21 include:

  • Specifies that retention under the Third Grade Reading Guarantee is triggered by failure to attain at least the “equivalent level of achievement” as determined by ODE
  • Exempts English language learners enrolled in U.S. schools for less than three years
  • Exempts students with significant cognitive disabilities from diagnostic tests on a case-by-case basis as determined by ODE
  • Requires the State Board of Education to adopt competencies for reading credentials and training by January 31, 2014. Requires all new applicants seeking an educator license for grades P-3 or 4-9 to pass an examination aligned with these competencies. Requires reading endorsement programs to align to these new competencies not later than July 1, 2016
  • Requires school districts and community schools that receive a D or F on the K-3 literacy progress measure on the new school district report cards and less than 60% of students score at least proficient on the third grade English language arts assessment submit a reading achievement improvement plan.

3rd grade reading guarantee changes again

The Ohio House finally moved SB21 out of committee. SB21 is the bill that tries to fix many of the problems raised by the initial third grade reading guarantee legislation. The Committee made a number of changes, but according to the bill's Sponsor, Sen. Peggy Lehner, she expects the Senate will agree with those changes.

According to a Gongwer report, the amendments made by the House include:

The omnibus amendment would add a requirement that all teachers providing reading guarantee services have at least one year of teaching experience unless they meet at least one of the bill's criteria to provide services and is mentored by a teacher with at least one year of experience, according to a Legislative Service Commission comparison document.

It also specifies teachers who qualify to provide services by virtue of a reading endorsement on their license must also have passed the State Board of Education-required assessment for the endorsement only "as applicable."

The latest version eliminates from the list of acceptable reading guarantee qualifications teachers determined by ODE as an "effective reading instructor" and teachers who completed a program from a list of scientifically researched-based reading instruction options.

The amended bill instead adds to the list of acceptable qualifications to include teachers:

  • Rated "most effective" for reading instruction for the last two years based on assessments of student growth measures developed by a vendor approved by the state board.
  • Rated "above expected value-added" for reading for the two most recent years per criteria established by ODE.
  • Holding an educator license for teaching grades PreK-3 or 4-9 issued on or after July 1, 2017. The omnibus amendment requires all new applicants for educator licenses for those grades pass an exam aligned with reading competencies established by the state board.

The state board is required to adopt those competencies Jan. 31, 2014 under the bill, and must cover all reading credentials and training that include an understanding of phonemic awareness, phonics, appropriate use of assessment, appropriate instruction materials, among others.

Starting July 2014, alternative credential and training that qualify a teacher to instruct students identified by the reading guarantee would be aligned with the reading competencies, according to LSC.

Those teachers who do not meet the listed qualifications nor have one year teaching experience would be permitted to provide reading guarantee services if he or she holds an alternative credential or has successfully completed training using research-based reading instruction approved by ODE.

The omnibus amendment also puts in place ramifications for schools that fail to perform on reading aspects of the state report card. Schools would be required to submit improvement plans to ODE if they receive a D or F on the K-3 literacy progress measure and less than 60% of their students who took the third-grade English language arts assessment attained at least a proficient score, according to LSC. Submission of improvement plans would start in 2016.

A school could cease submitting an improvement plan if it receives a grade of C or better on the K-3 literacy measure or at least 60% of students taking the third-grade ELA exam scored proficient or better.

Other changes made in the omnibus amendment include:

  • An exemption from the reading guarantee for those limited English proficient students who have been enrolled in U.S. schools for fewer than three years and who have had less than three years instruction in an English as a second language program. Current law exempts those with fewer than two years.
  • Allowing schools unable to meet personnel requirements to request a staffing plan beyond the 2013-14 school year. Those submitting plans must also report on progress the school has made in meeting requirements of the law.
  • Requiring ODE to study diagnostic assessments for reading and writing in grades K-3 that might be considered for approval by the state board.

Tea Party guide to legislative supporters

The Dispatch ran an article titled "Tea party has had it with GOP"

Feeling betrayed by the Republican Party and its leaders, tea party groups in Ohio appear to be uniting and moving toward either a split from the GOP or action to punish Republican candidates who fail ideological purity tests.

It remains uncertain, however, just how much the Ohio GOP and its candidates could be hurt by an insurrection because it is difficult to assess the true strength of tea party groups. A 2012 poll by The Washington Post and the Kaiser Family Foundation found that about 28 percent of Republicans identified themselves as tea party supporters.

To gage how much support the Tea Party has within the Ohio GOP legislative House caucus, we took a look at who had signed on to the Tea Party's pet union busting "right to work" cause. Spread across HB 151 (Private Employees "Right to work" bill) and HB 152 (Public Employees "Right to work" bill), the following Republican state Representatives sponsored or cosponsored one or both of these Tea Party bills

This represents 28% of the GOP house caucus, identical to the number of Republicans the Kaiser Family Foundation found identified as Tea Partiers. You will also note Rep Terhar on the list, he is the spouse of the Hitler referencing Debe Terhar, the President of the State Board of Education - quite the family of anti-working people policy advocates.

28% is quite a sizable rump for the more moderate Republicans to have to deal with, and it might be growing

But tea party leaders say their ranks are being swelled by social conservatives who oppose abortion and gay marriage and who are angry with the Republican Party.

This also corresponds with the information we published as to why some on the Ohio GOP were wanting to push "right to work" - it's all about bigotry

Harvey said the NEA has supported an “immoral, deviant and destructive” gay agenda for at least 25 years, citing its gay and lesbian caucus started in 1987. Harvey criticized the union for supporting a gay and lesbian history month, diversity training that included homosexuality, and pro-homosexual school counseling. She said the NEA has asked schools to protect students and staff from sexual orientation harassment and discrimination and has replaced the word “tolerance” with acceptance and respect.

“Kids are being trained as activists now,” she said.

Harvey said the NEA has voted to lobby for same-sex unions and said petitions are currently circulating to overturn the 2004 Ohio marriage amendment, which stated that that only a union between a man and woman would be recognized as a valid marriage. The OEA opposed the amendment.

It's hard believe that the "Tea party has had it with GOP" when at least 28% of the Ohio GOP's elected Representatives is made up of tea partiers.
