Teacher pay rules are off the chopping block for the Ohio House

COLUMBUS, Ohio - House leaders have dropped a plan to kill the minimum pay scale for teachers across Ohio.

Provisions in House Bill 343 would have eliminated a state requirement that teachers be paid a minimum amount based on their education level and years of experience.

But House leaders this morning removed those provisions, sending HB 343 to the full House without any reference to the pay schedule. The adjusted bill - described on the House floor as a "clean-up bill" that makes many small changes to previous laws - passed, with nobody raising any objections.

More Money for Low-Performing Charter Schools

Brennan strikes again: More money proposed for the drop-out recovery schools

The billion dollar charter school operator, David Brennan, is about to get a huge early Christmas gift. His charter school empire includes dropout recovery charter schools. One of his dropout recovery charter schools graduated 2 out of 155 students in four years. A provision in HB 343, which is currently sailing through the House, will allow drop-out recovery charter schools to enroll students up to 29 years old for GED or diploma programs at a cost of $5,000 per student.

This provision in HB 343 exacerbates the transfer of tax money to private hands. For decades, Ohio public schools have provided adult basic education programs with remarkable results. The Johnny-come-lately state officials may be unaware of this.

Ohio’s For-Profit Charter Schools Drag State Into Group Of Nation’s Worst Performers

The paper found that:
• Charter schools that hired no company, as a group, performed the best academically; those managed by nonprofits showed the best student academic growth; and those managed by for-profits scored lowest in both categories.

• Of the 16 lowest performing networks, 14 were managed by for-profit companies.
• The online charter schools Electronic Classroom of Tomorrow and Ohio Virtual Academy, which account for a quarter of all charter enrollment, averaged the lowest student growth in the state.

• Of the 12 highest-performing charter school networks, eight hired nonprofit management organizations.

• $503 million of $920 million in public funding went to charter schools managed by for-profit companies. A little over half of the $920 million went to out-of-state companies.
• Out-of-state and for-profit companies enrolled 74,458 of the 119,271 Ohio charter school students.

• The 10 highest performing companies managed schools with above-average revenue, many propped up by private philanthropists who invest in successful academic models. Others got a boost from Cleveland voters, who approved additional local aid (about $1,000 more per pupil) for high-performing charter schools. A similar local levy failed in Columbus. The state offers no financial incentive for top-performers.

Better To Stay At Athens County Schools Than Charter Alternative

When charter schools were authorized in Ohio, the idea was to give pupils a chance to go to a better school than the public school in their home district. Figures from the state proficiency tests have indicated that in general this may not be happening.

Now a compilation of figures for all 611 public school districts by the Ohio Education Association and Innovation Ohio gives more precise information. Figures for each district include the amount of money taken from that district and which charter school it went to.

The state proficiency rating based on test scores, graduation rate and attendance are shown for the public schools and the charter school. Each entry also includes average years experience for the teachers at that charter school, how much the state gives the school and the percentage of the budget used for instruction.

All this is in a very user-friendly web site called KnowYourCharter.com. You can go to any of the 611 districts very easily.

I looked at the figures for the five districts in Athens County. There are slightly more than 200 pupils from Athens County going to a charter school. More than $1.5 million is being taken by the state and given to charter schools.

This is Athens County money leaving Athens County because there are no charter schools in Athens County. We don’t really need that kind of help from the state.

Not one of the pupils from Athens County is attending a charter school with a higher performance rating than the public school in their home district.

Furthermore, 64 percent of the money and 64 percent of the pupils are going to charter schools with lower performance ratings than the school in their home district.

In short, as far as Athens County is concerned, the charter school movement is not meeting its promise. It is not improving education in this county.

Part of the reason for the charter schools is the poor performance of schools in the big cities in Ohio. Are charter schools more help there? I looked up the figures for Columbus schools. There are more than 15,000 pupils from Columbus schools in charter schools and the state takes $116 million from the Columbus district.

The performance grade for Columbus schools is a D, and 30 percent —only 30 percent — of the Columbus pupils are in a charter school with a performance rating of D.

Maybe this awesome collection of data will wake up the Ohio Legislature and the Ohio Department of Education. The charter school movement in Ohio is in big trouble.

White Hat’s Magic Trick: Transforming Public Schools Into Private Assets

There’s a lot of money at stake in Ohio charter schools, which as a group will receive almost $900 million in 2014. Charters get about $7,200 per student in taxpayer funding, compared to about $3,500 per student in traditional public schools.

On paper, Ohio’s charter schools are operated by non-profit organizations whose governing boards hire management companies to operate the schools. The boards are supposed to have a strong oversight role and have the power to fire charter operators if they don’t measure up.

It’s a particularly important role, given how poorly many charter schools perform. Since Ohio’s experiment in school privatization began, around 29 percent of the charter schools opened in the state have been closed, and according to Ohio Department of Education board member Mike Collins, the state has spent over $1.4 billion just since 2005 on charters that never scored above a D on their annual report cards.

Oversight is impossible without transparency. But when the governing boards at ten Ohio charters run by White Hat Management tried to find out how the company was spending its budget, the company simply refused to provide detailed records, claiming that information about how it was spending taxpayer money was proprietary.

The years-long legal struggle which is pending in the state Supreme Court relates to two questions at the heart of the school privatization controversy: When do public funds become private assets? And how much transparency do private companies owe when they provide public services on the public’s dime?

Oversight by a Hand-Picked Board
Ohio’s charter schools, which are publicly funded, are supposed to be subject to periodic state audits and held to performance standards by the sponsoring organizations that contract with operators.

But governing boards may not be as independent as they ought to be, as a 2014 investigation by the Akron Beacon Journal found. White Hat shares legal representation with the boards of many of the charter schools it has contracts with. And a number of board members have admitted that they were recruited by White Hat, a clear conflict of interest.

In a revealing statement, Maggie Ford, chief academic officer at White Hat, told the Beacon Journal, “Sometimes we have one or two people that would like to start a school, and they don’t have enough for an entire board. So they want to, they talk to, other board members or ask us to help recruit board, um, recommend board members.” In effect, the boards at many “nonprofit” charter schools were hand-picked by White Hat, which contracted with those same boards to operate the schools.

But the problems really started when board members at Hope Academies and Life Skills Centers started to examine White Hat’s operations. By 2010, board members at ten schools in Cleveland and Akron were concerned about whether resources were being used effectively at their schools, but the company had provided little information about its spending even to the boards of its schools.

As board member Lillie Blair explained to the Cleveland Plain Dealer, “The public says, ‘You’re responsible for the money we gave you – what did you do with it?’ And I as a board member have to say I don’t know.”

The boards had essentially agreed to pass over 95 percent of the schools’ budgets to White Hat, which then had sole responsibility for everything from hiring teachers to buying school supplies. In 2010, after White Hat refused to provide any additional details about its budgets, the ten school boards sued.

The lawsuit, Hope Academy Broadway Campus et al. v. White Hat Management, LLC et al., claims that White Hat didn’t meet its contractual obligations because it didn’t provide quarterly un-audited financial disclosures, it didn’t adequately track how various grants were spent, and it “failed to promote the academic success of each school’s students.”

When the boards that hired White Hat to manage their schools began demanding financial transparency, White Hat pushed back, insisting that it wasn’t required to provide full quarterly financial reports. When the Ohio House held a hearing about the complaints against White Hat in 2010, the company refused to testify.

#5of8 Row draws strange bedfellows

We reported yesterday on the Ohio State Board of Education's plans to eliminate the 5 of 8 rule. The Boards' Operating Standards Committee met yesterday to discuss the rule and vote it out of committee. It passed 4-3, but those supporting and opposing the measure were not who you would expect.

"I've been receiving a lot of feedback," said committee member Kathleen McGervey of Avon, who voted no after she started receiving calls with objections this weekend. "I just wanted a little more time to hear them out."

Board member Sarah Fowler, the vice chair of the Operating Standards Committee from Ashtabula County, also voted against sending the change to the full board. She said emails from constituents Sunday and Monday convinced her to consider the issue further. Fowler also represents Geauga and Portage counties.

Her biggest concern: "Making sure we're not incentivizing districts to not provide certain things for their students."

Also voting no was Stephanie Dodd, of Hebron.

Sarah Fowler is the home-schooler on the board and typically has not been friendly towards public education. The volume of complaints she and other board members have been receiving have clearly been having an effect. Back the the Plain Dealer

Committee chairman Ron Rudduck, Board President Debe Terhar, and members Tess Elshoff and Brad Lamb, of Westlake, voted to approve the changes for full board consideration.

It should be no surprise that Debe Terhar continues to act against the best interests of students, and Brad Lamb was just voted out of office only 7 days ago to be replaced by a veteran teacher, Roslyn Painter-Goffi. The disappointing yes vote was that of Ron Rudduck.

Rudduck received strong backing from educators in the November elections, believing he was a moderate Republican voice with strong pro-public education beliefs guiding his decisions. Today, the State board of Education will hear public comments, one of the groups testifying will be the Ohio Education Association - the organization that represents 121,000 teacher in Ohio. Here's why they believe it is critical to keep the 5 of 8 rule.

When the Board votes on the recommendations of the Operating Standards Committee, we ask that you restore this language in Rule 5 for the following reasons:
• Removing the Current Rule 5 language would have the immediate effect of further reducing the educational opportunities that are available to boys and girls in Ohio’s schools.

• Current Rule 5 language already provides significant flexibility to local school districts; there is no compelling reason to change it.

• Without rules requiring Ohio’s schools to provide specific services that meet the needs of the whole child (including school counseling, nursing, library media support, social work, and elementary art, music and physical education instruction), school districts will have the incentive to focus personnel and other resources only on tested subjects.

• Maintaining the “5 of 8” rule demonstrates that the State Board of Education is committed to equal educational opportunity for all of Ohio’s students. If the 5 of 8 rule were eliminated from the Operating Standards, children from low-wealth communities—those who need these services the most—would be the most likely to be deprived of the support they need for a well-rounded education.
